Acceptable Use Policy
This Acceptable Use Policy document, including the following list of Prohibited Activities, is an integral part of your Hosting Agreement with Hizakura B.V.. If you engage in any of the activities prohibited by this AUP document Hizakura B.V. may suspend or terminate your account.
Hizakura B.V.'s Acceptable Use Policy (the "Policy") for Hizakura B.V. Services is designed to help protect Hizakura B.V., qde B.V.'s customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by qde B.V.. Hizakura B.V. reserves the right to modify the Policy at any time, effective upon posting at Terms of Service.
Prohibited Uses of Hizakura B.V. Systems and Services:
Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through qde B.V.'s servers is prohibited. Likewise, the sending of UBE from another service provider advertizing a web site, email address or utilizing any resource hosted on qde B.V.'s servers, is prohibited. Hizakura B.V. accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.
Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by Hizakura B.V. customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any Hizakura B.V.-hosted domain, or referencing any Hizakura B.V. account, is prohibited.
Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at Spamhaus.
Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").
Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any Hizakura B.V. customers or end-users by any means or device.
Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the Hizakura B.V. network or on another provider's network.
Using Hizakura B.V.'s Services to interfere with the use of the Hizakura B.V. network by other customers or authorized users.
Any other activity that is illegal under Dutch law.
Strictly Prohibited Uses
- Botnets
- Child Pornography
- Crypto coin mining / Storj node / IPFS gateway or other P2P sharing services
- Counterfeit / Fake / Replica product websites
- Exploit / Vulnerability scanning
- Grid computing (Folding / Hentai @ home and equivelants)
- Phishing
- SPAM bots
- Stress / Flood tools
Network Connectivity
Hizakura B.V. can absorb and tolerate occasional DDoS attacks, but customer’s who are targeted with frequent and/or disruptive attacks can be suspended or terminated upon review.
Customer’s may not use our network and services to send DDoS attacks or other kind of floods, any kind of abusive network usage may result in suspension and/or termination.
Hardware Resource Usage (VPS services)
Client agrees not to run any processes on his or her VPS which use the equivalent of 50% or more of all available CPU capacity for an extended period of time. As an example, a VPS with four (4) cores assigned may not use more then two (2) full CPU cores for an extended period of time. An extended period of time will generally mean two (2) hours, but will depend upon the CPU load and level of impact on other clients sharing the physical server. Disruptive CPU usage may result in a reboot, shutdown, and/or suspension of the VPS regardless of the time lapse involved.
LIR Services
Prohibited Uses
Any IP address or ASN leased, registered, or obtained through Hizakura B.V. must not be used for:
- Activities prohibited under Dutch law.
- Spamming, unauthorized scanning, hacking, phishing, or other malicious or illegal activities.
- Any use that violates RIPE policies or terms.
Enforcement
We reserve the right to suspend or terminate services related to IP leasing or ASN registration if we detect a violation of our AUP, TOS, or RIPE policies and terms.
Customer Responsibility for Customer's Users
Each Hizakura B.V. customer is responsible for the activities of its users and, by accepting service from Hizakura B.V., is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of an Hizakura B.V. customer will be forwarded to the Hizakura B.V. customer's postmaster for action. If violations of the qde B.V. Acceptable Use Policy occur, Hizakura B.V. reserves the right to terminate services with or take action to stop the offending customer from violating Hizakura B.V.'s AUP as Hizakura B.V. deems appropriate, without notice.
Termination due to AUP Violation
Hizakura B.V. reserves the right to terminate or suspend services without prior notice if the user violates any part of this AUP. We commit to sending a warning email to the user before such actions, where feasible.

Users and the general public are encouraged to report violations of this AUP to our designated abuse team via email. Please refer to our contact page for contact information.
